1. Our services
File Drop provides temporary QR-based sessions for transferring files between connected devices. Sessions may include phone-to-computer and computer-to-phone transfers, account access, recent transfer information, and related browser or extension interfaces.
Transfer links and QR codes are intended for private use. Sessions expire after a limited period based on the active plan and are not permanent cloud storage. Service availability, limits, supported file types, and features may change.
File Drop is not tailored to comply with industry-specific requirements such as HIPAA, FISMA, or financial-services recordkeeping rules. Do not use the service where such compliance is required unless we expressly agree in writing.
2. Intellectual property rights
File Drop and its licensors own the service software, interfaces, branding, text, graphics, code, and other materials, excluding files and content submitted by users. These terms grant you a limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose.
You may not copy, sell, license, reverse engineer, scrape, or create derivative works from File Drop except where applicable law expressly permits it.
3. User representations
You represent that account information is accurate, you have legal capacity to accept these terms, you will protect your credentials and session links, and you have the necessary rights and permissions to transfer every file you submit.
You must not use File Drop if you are prohibited from receiving the service under applicable law. Users under 18 may use the service only where legally permitted and with required parental or guardian consent.
4. Prohibited activities
You may not use File Drop to:
- transfer unlawful, infringing, abusive, deceptive, or malicious content;
- distribute malware, spyware, ransomware, credential-stealing tools, or harmful code;
- violate privacy, intellectual property, export-control, or other legal rights;
- probe, bypass, disable, or interfere with authentication, rate limits, access controls, session expiry, or security features;
- share QR codes or session tokens publicly, impersonate another person, or access another user’s transfers without permission;
- automate abusive traffic, overload the service, scrape private data, or use the service to build a competing service;
- transfer regulated or highly sensitive data where File Drop has not expressly agreed to the required safeguards.
5. User generated contributions
Files, file names, messages, and other content you submit remain yours. You are solely responsible for that content and for ensuring it does not violate law or third-party rights. File Drop does not provide public posting or browsing features, but content is transmitted through our systems to complete your requested transfer.
6. Contribution license
You grant File Drop a limited, worldwide, royalty-free license to host, process, reproduce, and transmit submitted content only as necessary to operate, secure, and complete the transfer service. This license ends when the content is deleted, except for limited backup, security, or legal retention where required.
7. Services management
We may monitor service operation, enforce these terms, investigate suspected abuse, restrict files or sessions, suspend accounts, and cooperate with lawful requests. We may set or change technical limits, including file size, transfer count, storage duration, session duration, and supported browsers or devices.
8. Term and termination
These terms apply while you use File Drop. You may stop using the service at any time. We may suspend or terminate access when reasonably necessary for security, legal compliance, service integrity, nonpayment of a future paid plan, or a breach of these terms.
Termination may result in loss of account access and deletion of associated information, subject to the Privacy Policy and legal retention obligations.
9. Modifications and interruptions
We may modify, pause, or discontinue all or part of File Drop. We do not guarantee uninterrupted access or that every device, browser, network, or file type will work. Maintenance, provider outages, security events, and circumstances outside our control may interrupt transfers.
10. Governing law
The governing jurisdiction and applicable law are To be confirmed. Mandatory consumer protections in your place of residence may still apply.
11. Dispute resolution
Before filing a formal claim, you and File Drop agree to attempt in good faith to resolve the dispute by contacting support@filedrop.my. Any arbitration terms, court venue, class-action waiver, or other formal dispute procedure are To be confirmed.
12. Corrections
Information in the service may contain typographical, technical, pricing, or descriptive errors. We may correct errors and update information at any time. If a correction materially affects a paid purchase in the future, applicable refund and consumer-protection rights will apply.
13. Disclaimer
To the fullest extent permitted by law, File Drop is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and error-free operation. We do not guarantee that a transfer will complete, that a file will remain available, or that the service will detect every harmful file.
You are responsible for maintaining your own copies and backups. File Drop is a transfer utility, not a permanent storage or backup service.
14. Limitations of liability
To the fullest extent permitted by law, File Drop and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, files, profits, business, or goodwill arising from use of or inability to use the service.
The maximum aggregate liability cap and any exceptions are To be confirmed. Nothing in these terms excludes liability that cannot legally be excluded.
15. Indemnification
To the extent permitted by law, you agree to defend and indemnify File Drop and its operators against claims, losses, and reasonable costs arising from your submitted content, misuse of the service, violation of these terms, or infringement of another person’s rights.
16. User data
We process account and transfer data as described in the Privacy Policy. Temporary files may be deleted after download, cancellation, expiration, or operational cleanup. You are responsible for preserving original files and should not rely on File Drop as your only copy.
17. Electronic communications, transactions, and signatures
Using File Drop, emailing us, and submitting electronic forms are electronic communications. You consent to receive notices electronically where permitted. Electronic acceptance and records may satisfy legal writing and signature requirements.
18. Miscellaneous
These terms and the Privacy Policy form the agreement governing File Drop. If a provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. You may not assign your rights without consent; File Drop may assign the agreement as part of a reorganization or business transfer, subject to applicable law.
